This Conditions Of Use Agreement ("Agreement") is made between LBSS and any person (collectively "you", "your" or "I") who visits lilbrown.com, including anyone who completes the process to purchase or obtain any goods or services made available on this web site.

You hereby understand, agree, and acknowledge that all applicable state and local taxes are the responsibility of the purchaser. Federal taxes have been paid.

BY PLACING AN ORDER, YOU EXPRESSLY AGREE TO AND CONSENT TO BE BOUND BY ALL OF THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT PROCEED TO CHECKOUT.

Credit card charges are not submitted until time of shipment. LBSS does not apply any surcharge for credit cards.

PAYMENT

By entering into any transaction with LBSS, you agree to pay in full the purchase price, shipping and other charges. You expressly authorize LBSS to charge your credit card for all such amounts. Failure to pay for any product or service purchased or obtained on this web site, for any reason, may result in legal action against you. If such legal action is necessary, LBSS is entitled to recover in full the product or service sold or obtained, and any and all charges applicable to this transaction, including, but not limited to, any collection and courts costs and/or attorney's fees.

PRICES, SHIPPING & HANDLING

All prices are stated and subject to change whitout notice. Payment is in US dollars. Shipping charges apply to all orders. Shipping might be added or adjusted at checkout.

RISK OF LOSS

All items purchased from LBSS are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier on the Yakama Nation. As such, any transaction with you occurs on the Yakama Nation.

REPRESENTATIONS AND WARRANTIES

You represent and warrant to LBSS that:

You are/or over the age of nineteen (19) and have the power and authority to enter into and perform your obligations under this Agreement;
You represent and warrant that you have provided accurate and complete information, including, without limitation, your legal name, address, telephone number and credit card information, date of birth, age, and you are the authorized user of the credit card used for this transaction;
You represent and warrant that the products that you are purchasing from lilbrown.com are being purchased solely for your own personal use and consumption and that you are not purchasing any such products for any other purpose;
You shall comply with all terms and conditions of this Agreement;
You understand that LBSS will show up on your credit card statement and you will take steps so that no accidental charge backs occur by ensuring that whoever receives the credit card statement is aware of this purchase.

PRIVACY

It is the policy of LBSS to respect your privacy. LBSS will not monitor, edit, or disclose any personal information about you to any third party without your consent.

APPLICABLE LAW, JURISDICTION & VENUE

You understand that LBSS is a tribally-llicensed business of the Yakama Nation and that this entire transaction takes place within the boundaries of the Yakama Nation. You further understand that you are entering into a consensual business transaction with LBSS.

By visiting lilbrown.com you agree that the laws of the Yakam Nation will govern any dispute, claim, or cause of action arising out of or relating to your purchase from lilbrown.com, including without limitation any dispute regarding the nature or quality of the goods, or any claim that this transaction violates the laws of any state.

You further agree that the Yakama Nation Tribal Court will be the exclusive venue to resolve any dispute, claim or cause of action arising out of or relating to your purchase from lilbrown.com and that you waive any defenses such as forum non conveniens, lack of tribal court jurisdiction, and lack of personal jurisdiction.

LBSS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR ANY GOODS OR SERVICES PURCHASED BY YOU THROUGH THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, STATUTORY, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
